I appreciate the effort by the Pagosa Springs SUN to share the article about Nicholas Kazarinoff and Linda Coyote, in its November 25 issue. What the SUN left the readers with is unclear. Half of the story, on two very important issues, was presented.
First, the unconstitutional mask mandate perpetrated by the District Court judge and the constitutional protected right of all people, to completely ignore unconstitutional and unlawful mandates from government employees. Judges are servants of the people and they have no constitutional authority to create law.
Second, the SUN present one side of a story that involves the county attorney and commissioners violating the state constitution by taking someone’s private property for public use, without just compensation. Kudos for at least printing the photo of the private gate before it was destroyed by Metro District personnel.
Had the SUN done due diligence in preparing this story, they would have included a photo of the private property that was destroyed. The public photo that they did print is evidence, for all county residence to see, that a turnaround had never been developed on private property. We can clearly see large tress within, in the judge’s stated 4,835 square foot turnaround boundaries. That one big pine tree must have stood for a hundred years and that tree would have been removed if a turnaround been developed on that piece of land.
The County attorney committed fraud on the court and all county residence, when he presented false evidence and testimony that a turnaround had been constructed in that location. The SUN photo clearly proves that no drainage has been graded, and no gravel placed to protect the roadbed. The drainage ends right at the property line because that is where the road ends on all of the plat maps filed with the County Assessor’s office. Colorado is an open-range, fence-out state. Anyone who wants to drive to the top of Oak Ridge Drive will find that Mr. Kazarinoff has placed fences around much of his property that borders the public right of way.
Once again, I wish to thank the SUN staff for printing that photo for the whole world to see, because it proves that fraud and grand theft is being committed by several people in our local government. At a minimum the judge’s order must be vacated and, in the name of justice, anyone who has falsely testified or presented false evidence to mislead the judge should be punished to the fullest extent of the law.
